New structure of the Ministry of Justice

Today, March 10, 2020, the Council of Ministers approved the new structure of the Ministry of Justice.

In the changes produced, the competences it had been exercising in matters of Religious Freedom and Historical Memory, have been incorporated to the Ministry of the Presidency, Relations with the Courts and Democratic Memory.

The Secretary of State for Justice directs the new General Secretariat for the Innovation and Quality of the Public Justice Service, which replaces the former General Secretariat for the Administration of Justice.

This General Secretariat is born with the challenge of operating a structural transformation of the right to access to justice and effective protection in the exercise of their rights and legitimate interests. The following depend on it:

The General Directorate for the Public Service of Justice, (formerly the General Directorate for Relations with the Administration of Justice), sees 4 General Sub-Directorates being abolished and 5 being created, with name changes.

Those to be deleted:

  • Subdirectorate for Relations with the Administration of Justice and the Public Prosecutor’s Office
  • Subdirectorate for Personal Resources in the Service of the Justice Administration
  • Subdirectorate for Economic Resources of the Justice Administration
  • Subdirectorate for Organization and Territorial Coordination of the Justice Administration

Those created:

  • The Subdirectorate for Institutional Collaboration for the Public Justice Service.
  • The Subdirectorate for Access and Promotion of Justice Administration Personnel.
  • The Subdirectorate for Economic Programming of the Public Justice Service.
  • The Subdirectorate for Cooperation and Territorial Coordination of the Administration of Justice.
  • The Subdirectorate for the Innovation and Quality of the Judicial and Prosecutorial Office.

The Directorate General for the Digital Transformation of the Administration of Justice, (formerly the Directorate General for the Modernization of Justice, Technological Development and Asset Recovery and Management), has abolished 3 Sub-Directorates, transferred 2 to the Directorate General for Legal Security and Public Faith and created 2.

Those to be eliminated:

  • The Subdirectorate General for Modernization Programming
  • The Subdirectorate for New Justice Technologies
  • TheSubdirectorate for the Administrative Registries of Support to the Judicial Activity
  • The Subdirectorate for the Location and Recovery of Assets (transferred)
  • The Subdirectorate for the Preservation, Administration and Realization of Assets (transferred)

Those created:

  • The Subdirectorate for Digital Transformation Planning and Management
  • The Subdirectorate for Development and Implementation of Digital Services

The General Directorate of Legal Security and Public Faith, (formerly the General Directorate of Registries and Notaries and under the Undersecretariat), maintains:

  • The Subdirectorate General of Nationality and Civil Status
  • The Subdirectorate General of Notaries and Registries

Y welcomes (from the Directorate General for the Modernization of Justice, Technological Development and Asset Recovery and Management).

  • The Subdirectorate General for Property Location and Recovery
  • The Subdirectorate General for Conservation, Administration and Realization of Assets

Therefore, from now on it is composed of:

  • The Subdirectorate General of Nationality and Civil Status
  • The Subdirectorate for Notaries and Registries
  • The Subdirectorate for the Localization and Recovery of Assets (transferred)
  • The Subdirectorate for the Preservation, Administration and Realization of Assets (transferred)

The General Directorate of International Legal Cooperation and Human Rights maintains its structure, although without the Sub-Directorates corresponding to Religious Freedom, which, as mentioned above, is transferred to the Ministry of the Presidency, Relations with the Courts and Democratic Memory.

In the Undersecretariat, the previous structure is maintained, except for the suppressed General Directorate of Historical Memory (which, as mentioned above, is transferred to the Ministry of the Presidency, Relations with the Courts and Democratic Memory) and the General Directorate of Registries and Notaries (on the basis of which the General Directorate of Legal Security and Public Faith has been created).

There is only a minimal change in the name of the Subdirectorate General for Contracting, Economic Management and Public Administration.

The other change already indicated is that the General Sub-Directorate for Relations with the Confessions (now called General Sub-Directorate for Religious Freedom) is attached to the Ministry of the Presidency, Relations with the Courts and Democratic Memory.

Finally, this Bill amends the Regulations of the State Legal Service, approved by Royal Decree 997/2003, of July 25, 2003, in order to adapt the regulation in aspects of a purely organizational nature, particularly as regards the functions of the Subdirectorate General for Coordination, Auditing and Knowledge Management.
